TERMS AND CONDITIONS

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over.
  3. Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Entries into the promotion open on 15/09/2025 and close 11:59pm AEDT on 21/10/2025 (“Promotional Period”).
  5. A “Participating Store” is any Cellarbrations, The Bottle-O and IGA Liquor store nationally that advertises the promotion and stocks the Eligible Product (defined below) during the Promotional Period.
  6. To be eligible to enter, individuals must spend, in a single transaction, $25 or more on any Jim Beam product (“Eligible Product”) at a Participating Store and obtain a purchase receipt during the Promotional Period (“Qualifying Transaction”). If a purchase receipt is not provided to the individual, it is their responsibility to request one from a staff member.
  7. To enter, individuals must then visit jimbeampromotions.com.au/iba-car-cash, follow the prompts to the promotion entry page, input the requested details and submit the fully completed entry form during the Promotional Period.
  8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the amount spent in excess of $25 in the Qualifying Transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) only one (1) entry permitted per person per day.
  9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. The draw will take place at Level 3/162 Collins St, Melbourne VIC 3000 on 27/10/2025 at 11:00am AEDT, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by email and phone within two (2) business days of the draw. The winner’s first initial, surname and postcode will be published at jimbeampromotions.com.au/iba-car-cash on 31/10/2025. If the winner does not confirm that they can attend the Game (defined below) by 11:59pm AEDT on 10/11/2025, the opportunity to play the Game will be forfeited and an unclaimed prize draw will be conducted in accordance with clause 32.
  14. The Promoter’s decision is final and no correspondence will be entered into.
  15. The first valid entry drawn will win that entrant (“Participant”) the opportunity to play a contingency game (“the Game”) for the chance to win the choice of either:
    • One (1) restored and customised Volkswagen Kombi vehicle with either an automatic transmission or manual transmission, depending on the winner’s preference and the availability of the Volkswagen Kombi vehicle, up to the value of $105,000 (including both the value of the Volkswagen Kombi vehicle and customisation costs) (subject to clauses 22 and 24); or
    • $105,000 cash (awarded in the form of an electronic funds transfer (“EFT”) into the winner’s nominated Australian bank account in the winner’s name within 28 business days of the Game taking place).

  16. “Major Prize”
  17. The Game will take place at Darling Park - Tower 1, Level 18, 201 Sussex Street, Sydney NSW 2000 on 25/11/2025 at 11am AEDT. In order to participate in the Game, if the drawn Participant resides outside 200km outside of Sydney NSW, they will receive the below valued at up to $4,000 depending on the date and point of departure.:
    • Two (2) return economy airfares from their nearest capital city in Australia to Sydney, NSW;
    • One (1) night minimum 4-star accommodation for two (2) people (twin/double share); and
    • Return private airport transfers from Sydney airport to the accommodation.
  18. Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included.
  19. If the drawn Participant resides within 200km of Sydney NSW, the prize does not include airfares and the airfare component of the prize will be forfeited and not redeemable for cash. The Participant will be responsible for transport to and from the Game.
  20. If the Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. If the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.
  21. There will be 100 numbered envelopes on display at the start of the Game. One (1) game piece will contain a promotional message representing a custom built Kombi valued at up to $105,000 or $105,000 in the form of an electronic funds transfer, depending on the winner’s preference (“Major Prize”). The other ninety nine (99) envelopes will each contain a promotional message representing $20,000 in the form of an electronic funds transfer (“Minor Prize”). The Participant/proxy/representative (“Attendee”) must choose only one (1) envelope without touching, handling or interfering in any way with any of the other envelopes on display. If the Attendee is found to have breached this condition, they will be disqualified. If the Attendee selects the envelope containing the promotional message representing the Major Prize, then, subject to verification by the Promoter, the drawn Participant will win the Major Prize. If the Attendee selects an envelope containing a promotional message representing the Minor Prize, then the Major Prize will not be given away and, subject to verification by the Promoter, the drawn Participant will win the Minor Prize.
  22. The drawn Participant’s odds of winning the Major Prize, are 1 in 100. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the major prize, and will depend upon the number of entries received.
  23. The custom-built Volkswagen Kombi total prize value is up to AU$105,000 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner.
  24. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
  25. If the winner selects the restored VW Kombi in clause 15(a), the VW Kombi will be sourced and customised based on the winner’s preference, the winner’s location of residence in Australia and the availability of the VW Kombi up to the maximum total value of $105,000 (including the value of the KW Kombi vehicle and customisation). If there is no suitable VW Kombi available, the Promoter will engage a local specialist VW Kombi restorer, who will be employed to purchase a VW Kombi (subject to availability) and customise the VW Kombi, in accordance with the winner’s preferences, up to the maximum value of $105, 000 (including the cost of the VW Kombi vehicle). Any additional costs involved in customising the vehicle that exceeds the maximum total value of up to $105,000 (including the cost of the VW Kombi vehicle) will be the responsibility of the winner.
  26. Prize must be taken to coincide with the Game and is subject to booking and flight availability. The winner may be required to present their credit card at time of accommodation check in.
  27. The winner is responsible for providing full and accurate bank details. The Promoter will not be responsible for incorrect details being provided, a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
  28. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov. au.
  29. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  30. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  31. Total prize pool value is up to $109,000.
  32. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  33. A draw for the opportunity to play the Game for the chance to win the Major Prize, if unclaimed, may take place on 11/11/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within two (2) business days of the draw and their first initial, surname and postcode will be published at jimbeampromotions.com.au/iba-car-cash on 13/11/2025.
  34. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  35. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  36. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Game is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use prize / taking of the prize.
  39. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  40. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
